Judge says police violated rights of man accused of killing his 3 sons
BATAVIA, Ohio (WXIX) - A Clermont County judge ruled police violated the rights of a man accused of killing his three sons in June 2023.
Chad Doerman, 32, was indicted on 21 counts in Clermont County court, including nine counts of aggravated murder last summer.
Judge Richard Ferenc ruled on Friday that the Clermont County Sheriff’s Office violated his rights twice - when it failed to advise him of his Miranda Rights before interrogating him and when detectives continued to question him after he said he wanted an attorney.
The court ruled prosecutors couldn’t use statements or audio and video recordings from Doerman’s interrogation.
The Judge’s decision said, “The defendant’s Miranda rights were violated ... after the defendant unequivocally and unambiguously invoked his right to counsel when he told Det. (Michael) Ross, ‘I’ll wait for a lawyer, I don’t know, give me a couple of days, I can talk to a lawyer and get nice good answers.’
“Therefore, irrespective of the detectives’ failure to fully and properly advise Doerman of his Miranda rights as immediately set forth above, all statements obtained during the Custodial Interrogation shall be suppressed and the state shall not adduce any of these statements in their case-in-chief.”
The court ruled prosecutors couldn’t use statements or audio and video recordings from Doerman’s interrogation.
Attorneys for Doerman asked the court to suppress portions of his interrogation during a February hearing on violating his Miranda rights.
Doerman is accused of murdering his three sons - Clayton, 7, Hunter, 4, and Chase, 3 - at their Monroe Township home.
