2-year-old dies weeks after mother’s boyfriend allegedly abused him
The victim was hospitalized with a traumatic brain injury.

CINCINNATI (WXIX) - A two-year-old boy who was allegedly abused by a Colerain Township man died from his injuries over the weekend.
Elan Eris Bautista Aguilera, 2, was hospitalized at Cincinnati Children’s Hospital with a traumatic brain injury on Aug. 2. He died Saturday, Aug. 15, the Hamilton County Coroner’s Office confirms.
At the center of the investigation is 23-year-old Sebastian De La Cruz-Macal,
On Aug. 6, Cruz-Macal was indicted on felonious assault and child endangering charges in relation to Aguilera’s life-threatening injuries.
A criminal complaint says Cruz-Macal was watching Aguilera at his home at 10277 Roppelt Rd. in Colerain Township before the child was hospitalized.
The Hamilton County Prosecutor’s Office tells FOX19 NOW Aguilera is the child of Cruz-Macal’s girlfriend.
“Sebastian Macal did knowingly while providing supervision and care for two-year-old (Elan Aguilera) admitted to striking the child or the buttocks causing visible finger marks,” an affidavit says. “Also while in Sebastian’s care, he became unresponsive and was transported to CHMC where he was diagnosed with a traumatic brain injury.”

Cruz-Macal is currently behind bars at the Hamilton County Justice Center on a $505,000 bond.
Additional charges have not been filed by the prosecutor’s office yet as Colerain Township police continue to investigate the abuse-turned homicide case.
